Terms and Conditions of Use and Sale

2) Purpose
These Terms govern access to and use of www.presetground.com (the “Site”) and the purchase of digital content (e.g., presets, samples, MIDIs, templates and DAW projects) offered by Presetground (the “Products”).
3) Acceptance
By browsing or using the Site, you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.
4) Minimum Age
The Site is intended for users aged 18+ (or minors with parental/guardian consent).
5) Technical Requirements, Compatibility and Interoperability
Before purchasing, check the product page for compatible DAW and version, required plug-ins, supported operating systems, file formats and any technical protection measures (DRM) or usage limitations. Failure to meet these requirements on the user side does not constitute a product defect.
6) Prices, Taxes and Invoicing
Prices are shown in [currency] and include VAT for EU consumers unless stated otherwise. All amounts, taxes and any additional charges are disclosed prior to payment. You may request an invoice at info@presetground.com or download it from your account if enabled.
7) Pre-Contract Information (How to Buy)
Before you place an order you will be informed of:
add to cart → billing details → order review → payment → confirmation.
you can modify or remove items from the cart and review your details before paying.
the contract is concluded in English. If translations exist, in case of discrepancy the English version prevails.
we keep a record of your order and send email confirmation. If you have an account, you can view orders in your dashboard; otherwise request a copy via info@presetground.com.
8) Payment Methods and Security
We accept [cards / PayPal / other]. For anti-fraud reasons we may refuse or cancel orders, or request additional verification.
9) Delivery of Digital Content
Delivery is immediate after successful payment, via download link and/or access in your account. Download links may be time- or attempt-limited; if they expire, contact info@presetground.com with your order number. Please keep your own backup copies of files.
10) Right of Withdrawal (Returns)
For digital content not supplied on a tangible medium, the statutory right of withdrawal does not apply once you have expressly consented to immediate supply and acknowledged that you will lose the withdrawal right when the download/access begins.
If you have not downloaded or accessed the content and you have not given such consent, you may withdraw within 14 calendar days from purchase by emailing info@presetground.com with your order number and request.
11) Conformity, Updates and Support (Legal Guarantee)
If a digital product does not match its description, is not functional or has defects, you are entitled to have it brought into conformity (e.g., re-delivery/update/fix). If this is not possible within a reasonable time, you may request a proportionate price reduction or contract termination (where applicable).
We provide updates and/or information about them when necessary to maintain conformity for a reasonable period, considering the nature of the product and user expectations. For technical issues, email info@presetground.com including order number, DAW, version, OS and a problem description.
12) Licence to Use the Files
Unless stated otherwise on the product page, you receive a non-exclusive, worldwide, perpetual licence to use the files in your own music productions (including commercial works), royalty-free.
Not permitted:
a) reselling, redistributing, gifting, publicly sharing or uploading the raw files (presets, samples, MIDIs, templates) or their raw derivatives as packs, banks or libraries;
b) including the files (or raw derivatives) in competing products;
c) transferring or sub-licensing the licence to third parties;
d) using Presetground’s trademarks, logos or names in a way that suggests endorsement or authorship.
For teams/studios or multi-user scenarios, one licence per user is required (contact info@presetground.com for additional seats).
13) Reviews and Price Transparency
we publish reviews from verified buyers (completed order and/or manual verification). If non-verified reviews are shown, they will be labelled accordingly. Fraudulent reviews are removed.
when we show a discount, the “previous price” refers to the lowest price applied in the preceding 30 days, unless a legal exception applies.
we do not apply personalised pricing based on automated decision-making. If we ever do, we will clearly inform you before purchase.
14) Intellectual Property
All Site and Product content is owned by Presetground or its licensors. Unauthorised reproduction or exploitation is prohibited. Licensed uses are limited to Clause 12.
15) Acceptable Use of the Site
Do not use the Site in any way that damages, overloads or compromises its security, or for unlawful activities. We may suspend access in case of misuse.
16) Commercial Communications
We send marketing emails only with your consent or under the existing customer exemption permitted by law. You can unsubscribe at any time via the link in each email or by contacting info@presetground.com.
17) Cookies and Personal Data
Cookies are governed by our Cookie Policy, where you can manage consent. Personal data processing is described in our Privacy Policy, including controller identity, lawful bases, purposes, disclosures, retention, your rights (access, rectification, erasure, objection, restriction, portability) and how to exercise them with Presetground and, where applicable, with the Spanish Data Protection Authority (AEPD) at info@presetground.com.
18) Liability
We are not liable for indirect or consequential damages or loss of profits arising from use of the Site, except where such liability cannot be excluded by law. Nothing here limits mandatory consumer rights or our digital content conformity obligations.
19) Force Majeure
We are not responsible for failures caused by events beyond our reasonable control (e.g., third-party service outages, power cuts, cyberattacks, natural disasters).
20) Third-Party Links
External links do not imply endorsement. We do not control the content of third-party sites.
21) Governing Law and Jurisdiction
These Terms are governed by Spanish law. If you are a consumer, you also benefit from the mandatory protections of your country of residence. You may use Spain’s Consumer Arbitration System (Juntas Arbitrales de Consumo) or other ADR bodies. Without prejudice to statutory provisions, the courts of your consumer domicile shall be competent where so required by law.
22) Changes to the Terms
We may update these Terms when necessary. The version in force is the one published on the Site at the time of purchase. Changes do not affect completed purchases.
